Washington Wrongful Death Allows Families to Seek Compensation

By Hardwick & Pendergast, P.S. on June 29, 2011

In Washington and many other U.S. states, a “wrongful death” suit is a case in which the family or dependents seek compensation when a loved one is killed in an accident caused by another person’s or company’s negligence.

In 2011, Washington’s state legislature revised the laws governing wrongful death cases, but made no major changes. A wrongful death case in Washington must, in most cases, be filed by the personal representative, or the person in charge of handling the deceased person’s estate. The personal representative acts on behalf of the deceased person’s spouse, domestic partner, children, or other dependents.

The personal representative can bring a wrongful death case against anyone whose negligence may have caused the deceased person’s death. A wrongful death case is a civil suit, and the personal representative can pursue compensation even if the person or persons responsible for the death are also being charged with murder, manslaughter, or another felony under Washington law.

While no amount of money can replace a lost loved one, compensation for a wrongful death can help the family move forward in the face of loss. If you’ve lost a loved one in a Washington accident, please don’t hesitate to contact the experienced Seattle wrongful death attorneys at Hardwick & Pendergast, P.S.
